New comp: The Dark Side – 30 Sixties Garage Punk and Psych Monsters (CD/2LP)

Paying the Harry Fox agency for royalties is not of the same principle as the effort made by directly researching and contacting the copyright owners, the songwriters and the performers. Harry Fox does none of that, all they do is award percentages based upon currently registered affiliations with BMI and ASCAP. If they do not show a current registration, does anyone with the tiniest amount of common sense believe that someone employed at Harry Fox is going to do the work required to make sure some person who has no idea something they created or own is being recycled without consent (knowledge of, or financial potential)?

One of my freelance sideline gigs is researching copyright registrations, I get paid to uncover information only available by visiting and doing extensive research at the Library of Congress, along with other sources outside of copyright. I recently provided long buried and undocumented contact info for a small conglomerate involved in television and film. Harry Fox wasn't enough to satisfy legal obligations:lol: Defaulting payments to HFA under the guise of licensing is the lazy way out.

I don't know what their licensing policies are. I don't know if there will be fair compensation for the bands. But it seems it will be a legal release, whatever the shortcomings of that definition. I can say one thing from my own knowledge: the company was trying to contact at least a few of the bands. Anyone else with knowledge, rather than simple speculation, should comment.

Getting a license from Harry Fox only takes care of the mechanical / publishing income, not the use of the masters. If you used that logic, that would mean you could include Ticket To Ride by the Beatles on a comp just because you cleared the use of the song with Harry Fox. Many of these tunes probably aren’t registered any more anyway, but Harry Fox grabs the money anyhow. BBE is a UK label right? They should be going through MCPS then, not Harry Fox. If they want to use the master of Suzie Creamcheese, for example, then they’d need to get permission from the owner, Gradie O’Neal.

I'm not advocating anyone buy anything, I'm saying it looks like the company is doing more than just clearing publishing. At least Joey has some actual information to contribute. You are bitching about something you have no knowledge about.

I just wrote Ty Wagner and he hasn't got a clue about this comp.
If you look at the label, he wrote the damn song.
But this comp is "cleared"? Has he signed away the rights?
 
Joey D, MTM, Tim Warren, Tony Tyger et al put out compilations out of passion.
DJ:s put out comps like this to gain credibility. That's the difference

You have a point Mikael, but personally I think it's not worth worrying about. Keb (who I do not know personally) seems like a good guy and he comes from a different scene which has different standards. If he wants to put out a 60s garage comp which will appeal to his non-garage initiate followers, then I say go for it. It will only sell a micro pressing and it's not like anyone here has to buy it.

I have no idea and I don't really care if the 50 year old tracks are properly licenced or not. I'm not that much of a hypocrite, after spending thousands of $$$ myself knowingly buying unlicensed comps, and listening to unlicensed downloads for free on youtube, and sharing unlicensed copies with friends. Or after putting unlicensed music URL links up for sharing on forums or youtube or blogs or facebook. I'm sure no-one reading this has ever done any of that, have you? Just because you give something away for free after you steal it, doesn't mean it's not stealing. And after seeing how some major labels license un-findable artists through Bomp, Harry Fox and other entities to cover their ass, knowing that in many cases these entities do not control the copyrights...

I wouldn't put tony the tiger in with the legit guys, his says tony the tiger presents also, and they are bootlegs. Same if not worse than the DARKSIDE CD. And my stuff is local and even though Alec and I spent over 25 years looking for this stuff it was pretty easy to work deals out with local artists and labels. Tim Warren travelled the highways and biways for this stuff and is the true king.

I almost fully agree, I just think sticking their names on it like they are more important than the music is kinda lame. Like I said, I found a site that said "New DARKSIDE CD coming soon. Rare 60s blah blah blah and then the rest of the page was all about Keb and Cut Chemist. No track listings or lowdown on the cd itself. Like they were more important than the music. Typical Northern Soul mentality. And that cover. YUKKKKKKKKKKKKK!
 
I know. Like I said, there is a valid point being made. But I have seen these kind of topics before which start off as a mildly negative review, then the bile and hate gets turned up with each successive post. I seem to remember last time it was Crypt on the receiving end. Ironic. Since Keb is a member of G45central, his posts are courteous and friendly, and he is obviously genuinely interested in 60s garage, I will stand up for him within reason.
 
I'm not dreaming this up. What evidence do you have that they are not? The holier-than-thou attitudes around here are incredible.
Wasn’t Tony The Tyger’s claim also that he and Lee Joseph had cleared the songs with Harry Fox? Same deal as DARKSIDE . They called one of the comps “A Scene Inbetween" - but did they license the master for the Stained Glass from the correct owner Sony/BMG? Or the Odyssey from the owners of White Whale? I think not. It’s that same pseudo-legit claim as BBE. If you believe those guys, then I have Brooklyn Bridge to sell you. Plus the liner notes were full of inaccuracies (back me up here, MTM), which wouldn’t have been the case if they had actually bothered to track the musicians down. These are the guys that are holier than thou - at least the out-and-out bootleggers don’t try and make out they are experts or friends of the bands and labels they are short changing. And have the nerve to plaster their names all over the covers. Remember, I didn't start this thread, I'm only responding to posts.
 
The way I see it, a compilaton or repressing of an old 45 is only legal if:
The majority, or all of the tracks have been directly licensed from the copyright holders, with upfront royalties or compensatory monies paid to the performers prior to the release of the compilation.
Otherwise, the comp is an unauthorized (not legal) product, subject to any and all legal action instigated by the violated parties.

Paying royalties to the Harry Fox Agency does not in any manner satisfy the legal obligation of the parties who are taking musical works that were produced, sold and marketed by individuals who did not grant permission via a signed document, or were not contacted in the first place.

My view on the Keb + Cut Chemist comp - I don't care. In today's world, anyone who knows nothing about '60s garage music and wants to investigate the music has it SO easy - just surf around youtube, join forums, ask other people, listen to streaming programs, podcasts....Comps no longer serve any purpose in 2017 unless they significantly upgrade the product in a historical and archival manner ( vastly improved sound, new info, new pictures and unissued material never heard previously). The only purpose of this Dark Side comp is to potentially elevate record values among people who are generally clueless with such knowledge to begin with. Such is the modus operandi of the DJ scene. I've gone on and on about this before so no need to repeat.
